Terms and Conditions

Article 1 - Definitions

In these Terms and Conditions, the following terms have the following meanings:

Right of Withdrawal: The consumer’s right to cancel the remote agreement within the cooling-off period.

Consumer: A natural person acting for purposes outside their trade, business, craft, or profession, who enters into a distance contract with the entrepreneur.

Day: Calendar day.

Durable Medium: Any medium that enables the consumer or entrepreneur to store information in a way that allows future consultation and unchanged reproduction.

Entrepreneur: The natural or legal person offering products and/or services remotely to consumers.

Distance Agreement: A contract concluded between the entrepreneur and the consumer within a system organized for remote sales, where, up to the conclusion of the contract, only one or more remote communication techniques are used.

Remote Communication Technique: Means that allow for the conclusion of an agreement without the consumer and entrepreneur being simultaneously in the same room.

Terms and Conditions: These Terms and Conditions of the entrepreneur.

Article 3 - Applicability

These Terms and Conditions apply to all offers made by the entrepreneur and to every distance agreement concluded between the entrepreneur and the consumer.

To the extent permitted by local laws in the consumer's jurisdiction, Dutch law exclusively applies to these Terms and Conditions and the agreement.

For consumers outside the EU, in case of conflict with mandatory local laws, these Terms and Conditions will be adjusted as necessary to comply with local legislation.

If any provision of these Terms and Conditions is declared invalid or void, the remaining provisions remain in force, and the invalid provision will be replaced by one that closely matches the original intent.

Article 4 - The Offer

The offer includes a clear and accurate description of the products or services offered, including the price and any additional costs, such as customs duties and taxes.

Customs duties and import taxes outside the EU are the responsibility of the consumer and will be charged by local authorities or courier services upon delivery.

Images and specifications in the offer are indicative and are not binding on the entrepreneur.

The entrepreneur is not bound by the agreement in case of obvious errors or mistakes in the offer.

Article 5 - Right of Withdrawal

The right of withdrawal only applies to consumers in countries where it is legally required, such as within the EU.

Consumers in countries where the right of withdrawal is not mandatory are not entitled to this right unless explicitly agreed otherwise.

Article 6 - Payment

Unless agreed otherwise, the consumer must pay the amount due within 7 calendar days after the cooling-off period begins.

In case of late payment, the entrepreneur has the right to charge statutory fees, as permitted by the consumer's local legislation.

The consumer is required to immediately inform the entrepreneur of any inaccuracies in the provided or submitted payment details.

Article 7 - Complaint Procedure

Complaints regarding the execution of the agreement must be submitted in writing within 7 calendar days after the defect is discovered.

The entrepreneur will respond to complaints within 14 days of receipt. If a complaint requires more time to process, the consumer will receive an indication of the expected response time within 14 days.

For consumers outside the EU, a dispute may be submitted to arbitration or mediation, if required or permitted locally.

Article 8 - Termination of Ongoing Agreements

The consumer can terminate an agreement for an indefinite period, which involves regular delivery of products or services, with a notice period of up to one month.

The entrepreneur will not automatically renew agreements with consumers outside the EU unless explicitly agreed and in accordance with local laws.

Article 9 - Disputes

All agreements subject to these Terms and Conditions are exclusively governed by Dutch law.

For consumers outside the EU, disputes will be resolved according to the applicable law of the consumer's jurisdiction, as required by law.

The entrepreneur is not liable for claims or compensation outside the scope of these Terms, unless mandated by mandatory local legislation.

Article 10 - Liability

The entrepreneur is not liable for indirect damage, consequential damage, or any other damage arising from the use of the products or services unless mandatory local legislation provides otherwise.

The entrepreneur's maximum liability in all cases is limited to the amount the consumer paid for the relevant product or service.

Article 11 - Force Majeure

In the event of force majeure, including but not limited to natural disasters, war, fire, strikes, traffic disruptions, or supplier failures, the entrepreneur cannot fulfill the agreement.

If force majeure lasts longer than 30 days, the consumer has the right to terminate the agreement without further obligations.

Article 12 - Duration of Agreements: Duration, Termination, and Extension

The consumer can terminate an agreement for an indefinite period, which involves regular delivery of products (including electricity) or services, with a notice period of up to one month.

The consumer can terminate an agreement for a fixed period, which involves regular delivery of products (including electricity) or services, with a notice period of up to one month, unless otherwise agreed.

For agreements longer than one year, the consumer can terminate the agreement at any time after the first year, with a notice period of up to one month.

Article 13 - Payment

Unless agreed otherwise, the consumer must pay the amount due within 7 calendar days after the cooling-off period begins, as referred to in Article 6, Section 1.

In case of payment arrears, the entrepreneur is entitled to charge statutory collection costs.

Article 14 - Complaint Procedure

Complaints about the execution of the agreement must be fully and clearly described and submitted to the entrepreneur within 7 days of discovering the defect.

The entrepreneur will respond to the complaint within 14 days of receipt. If more processing time is needed, the consumer will receive an acknowledgment within 14 days, including an indication of when a detailed response will be given.

If a complaint cannot be resolved through mutual agreement, the dispute may be submitted to a disputes committee or arbitration, depending on the consumer’s local laws.
